Terms of Service

Markflow is an AI-assisted marking and feedback tool for teachers. It helps you mark student assessments faster by suggesting marks and generating feedback drafts. Every AI suggestion requires your review and approval before anything is finalised.

Markflow is currently in beta. During the beta period:

• Features may change, be removed, or behave unexpectedly
• Service availability is not guaranteed and downtime may occur without notice
• AI marking accuracy is provided on a best-efforts basis and may not meet production-level standards
• We may contact beta users to gather feedback about their experience
• Beta access may be provided free of charge or at a reduced rate at our discretion

Beta users accept that they are using an early version of the product and agree not to rely on Markflow as their sole marking or assessment record during this period.

Markflow is intended for use by teachers and educational staff. By creating an account you confirm that:

• You are 18 years of age or older
• You are using Markflow in a professional teaching capacity
• You have the authority to upload and process any student work you submit to the platform

You are responsible for maintaining the security of your account and password. You must not share your account with others. You are responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately atinfo@markflow.com.au.

Markflow processes student work and assessment data on your behalf. You remain the data controller for any student information you upload. By using Markflow you confirm that:

• You have appropriate authority to upload student work for processing
• You will comply with your school or institution's data handling policies
• You will not upload sensitive student information beyond what is necessary for marking purposes (name, assessment responses)

Markflow stores data on servers located in Australia (Sydney region). We do not sell, share, or use student data for any purpose other than providing the Markflow service to you.

Markflow uses artificial intelligence to suggest marks and generate feedback drafts. You acknowledge that:

• AI suggestions are starting points, not final decisions
• You are responsible for reviewing and validating all AI-generated marks and feedback before use
• Markflow does not guarantee the accuracy of AI suggestions
• Final marks and feedback remain your professional judgment as a teacher

You must not use Markflow to:

• Upload content that violates any applicable law or regulation
• Process data you do not have authority to handle
• Attempt to reverse engineer, copy, or resell the platform or its AI models
• Use the service in any way that could damage, disable, or impair Markflow

Markflow operates on a credit-based system. Free accounts receive 2 AI marking runs at no cost. Paid plans are billed monthly and include a credit allocation as described on our pricing page.

• Credits are non-transferable and non-refundable unless required by Australian Consumer Law
• Unused credits roll over subject to the cap described on your plan
• We reserve the right to change pricing with 30 days notice to existing subscribers
• Cancellation takes effect at the end of your current billing period

Markflow and its original content, features, and functionality are owned by Angus Southwood trading as Markflow. You retain ownership of any content you upload, including student work and marking keys. By uploading content to Markflow you grant us a limited licence to process that content solely for the purpose of providing the service to you.

We aim to keep Markflow available at all times but cannot guarantee uninterrupted access. We reserve the right to:

• Modify or discontinue features with reasonable notice
• Perform maintenance that may temporarily affect availability
• Update these Terms — we will notify you of material changes by email

Continued use of Markflow after changes to these Terms constitutes acceptance of the updated Terms.

To the extent permitted by Australian Consumer Law, Markflow is provided "as is" without warranties of any kind. We are not liable for:

• Errors in AI-generated marks or feedback
• Data loss caused by factors outside our reasonable control
• Indirect or consequential losses arising from your use of the platform

Nothing in these Terms excludes any rights you have under the Australian Consumer Law that cannot be excluded.

These Terms are governed by the laws of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
